Luxury Adventures, Ltd. dba: David Anderson Safaris designs & plans safaris for clients that want to experience Africa in style and comfort. Focus on Africa is also a dba of Luxury Adventures, Ltd. Focus on Africa’s mission is community development and conservation through sustainable ecotourism. Your travel arrangements for your Focus on Africa safari will be handled by a California Registered Seller of Travel (CRST,) referred to herein as the “tour operator.” The tour operator purchases transportation, hotel accommodations, restaurant and other services from various independent suppliers, who are not affiliated with the tour operator in any way. Although it chooses the best suppliers available, the tour operator has no right to control their operations and CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE which may occur due to (1) wrongful, negligent or arbitrary acts of omissions on the part of a supplier, its employees and others not under the direct control of the tour operator or (2) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers.
Payments made to Focus on Africa or David Anderson Safaris are not for travel services and are non-refundable. Payments made to the tour operators for travel service operating Focus on Africa Expeditions are held in a passenger trust account and are subject to cancellation fees as outlined herein.
LODGES, HOTELS AND TENTED CAMPS
The tour operator or its independent suppliers may find it necessary to make substitutions in the accommodations due to circumstances beyond the control of the company. Normally substitutions are of superior or equal quality. If a substitution of equal or superior quality cannot be secured, tour members will receive a refund for the difference in the form of credits towards future trips. No charge will be made for upgrades.
The tour operator has no control over any airline operations. Airline delays and extra expenses incurred because of airline delays are not the responsibility of the tour operator.
REALITIES OF TRAVEL IN THIRD WORLD COUNTRIES
Africa does have its primitive and rustic side. The tour operator is not responsible for the cleanliness of rest rooms, delays in immigration and customs, occasional equipment breakdowns, and other "third world country adventures" while you are in Africa.
OPTIONAL ACTIVITIES THAT MAY BE DANGEROUS
At some of the places you will visit on your tour, optional activities will be furnished by other independent suppliers who are not affiliated with the tour operator in any way. Some of these activities carry with them various inherent risks, including that of attack by wild animals, which can cause serious personal injury. These activities include, but are not limited to: (a) walking safaris; (b) horseback safaris; (c) camel safaris; (d) canoe trips; (e) hot air balloon trips; (f) Lake Victoria fishing village; (g) Masai village, (h) gorilla and chimpanzee trekking on foot and (i) elephant back safaris, (j) white water rafting, (k) bungee jumping. You should be aware that, although precautions are taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Should you elect to participate in such activities while you are on your tour, you are, of course, free to do so. However, you must understand that such participation will be at your own risk, and that the tour operator can assume no responsibility for your safety.
The tour operator requests common sense and caution be exercised while visiting any of the cities and towns on the tour. The tour operator is in no way responsible for incidents or personal or public interaction occurring between a tour member and anyone you may meet in Africa.
ACTS OF GOD AND THE LIKE
The tour operator is not liable for acts of God, fire, weather, acts of governments or other authorities, wars, civil disturbances, riots, terrorist acts, strikes, thefts, and pilferage.
CANCELLATION AND REFUNDS
All cancellations must be made in writing to the tour operator. Cancellation of your safari will result in the loss of any all money paid to Focus on Africa. Cancellation fees for your travel arrangements accessed by the tour operator for your safari are as follows:
89-60 days 30% of the retail safari price
59-45 days 40% of the retail safari price
44-30 days 60% of the retail safari price
after 30 days 100% of tour price
Safaris in Southern Africa may have higher cancellation fees which are disclosed at the time of booking.
Trip cancellation insurance is strongly recommended. There is no refund should you leave the safari early for any reason and no refund for any unused services.
TRANSPORTATION ON SAFARI
It is the policy of the tour operator to provide each client with a window seat while on game drives. However, the tour operator cannot be held responsible should vehicle breakdowns or local conditions result in an occasional situation where a window seat is not available.
The tour operator assumes no responsibility for the attitudes or personalities of tour members. Usually positive and friendly people take safaris. Those who have serious health problems, physical or mental, are asked not to sign up for this tour.
a) I certify that I have not recently been treated for, nor am I aware of, any physical or other condition or disability that would create a hazard to myself or other member of this tour.
b) I understand that acceptance of the Reservation Confirmation covering this tour and payment thereof is an acceptance by me of the tour conditions applicable to the tour. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THOSE CONDITIONS.
c) I understand that the tour operator reserves the right to adjust U.S. Dollar prices, without notice, to reflect fluctuations in the Foreign Exchange Markets the tour operator has no control over taxes or special assessments which may be imposed by African Governments.
d) I understand that the tour operator reserves the right to withdraw a tour or any part of it, to make such alterations in the itinerary and/or hotel accommodations as seems necessary or desirable, to refuse to accept or retain as a member of the tour any person at any time, and to pass on to tour members any expenditures occasioned by delays or events beyond its control (In case of an appreciable variation in cost in these, the right is reserved to make such adjustments to rates as necessary.).
e) I HAVE READ, UNDERSTAND AND AGREE TO THE CONDITIONS SET OUT UNDER THE HEADING "LIMITS OF FOCUS ON AFRICA RESPONSIBILITY."
